Personal Data Protection Notice INTRODUCTION Jakel Trading Sdn Bhd (Company No. 200901006566(849529-H)) of 7th Floor, Lot 159, Jakel Square, Persiaran Capsquare, Off Jalan Munshi Abdullah, 50100 Kuala Lumpur (referred to as “we”, “us”, or “our”) is obliged to comply with the Personal Data Protection Act 2010 (referred to as the 'Act') . For the purpose of Personal Data Protection Notice (referred to as the 'Notice'), the terms 'personal data' and 'processing' shall have the same meaning as prescribed in the Act. This Notice applies to Personal Data about customers held by us in relation to the Jakel Membership Card Programme (referred to as the “Programme”). We will only process your Personal Data in accordance with the Act. In the light of the Act, this Notice is to inform you on how we manage your Personal Data by collecting, recording, holding, storing and processing your Personal Data and to give you the options available to you to access or limit the use of the data provided. COLLECTION AND CATEGORIES OF PERSONAL DATA THAT WE COLLECT The Personal Data which means any information in our possession or control that relates directly or indirectly to the customer to the extent that the customer can be identified or are identifiable from that and other information in our possession that will be collected, recorded, held, stored and processed, and/or disclosed by us, including our employees, to be utilized and dealt with in accordance and in compliance with the Act. The Personal Data may include but not limited to: 1. name, identity card number and date of birth 2. contact details including address, phone number(s) and email address 3. occupation and marital status 4. family details 5. gender 6. photograph 7. bank details 8. any other personal data required for the purposes hereinbelow mentioned PURPOSE OF COLLECTION PERSONAL DATA The purposes of your Personal Data being collected from you and will continue to be used including but not limited to the following purposes 1. to process your Membership application of the Programme 2. to create your Account, once item 1 has been successfully processed (referred to as the “Account”) 3. to process and deliver Jakel Membership Card 4. to operate Members’ account by assessing and processing the Points of Rewards Statement 5. to respond to your request on the redemption of rewards 6. to communicate with you by delivering emails or letters on the benefits and changes to the features of the Programme 7. to decide matters in relation to the Membership including but not limited to suspend the provision of services or terminate the Membership 8. to update and improve your records 9. to administer surveys and types of research and/or statistical analysis including but not limited to consumer behaviour 10. to detect, investigate and prevent the act of cheating with respect of the implementation of the Programme 11. to advertise and promote the Programme through email, letters and social media platform 12. to respond to your enquiries made via call, email, letters, faxes, Facebook or social media platform 13. to conduct your participation in contests and administer the selection of winners for the said contest 14. to sharing your Personal Data with our joint venture/business partners to jointly develop the Programme 15. to confirm and check the validity of your identity as may be necessary or appropriate 16. to maintain and improve customer relationship with you and the upkeeping of any matters relating thereto. Pursuant to the above purposes, we may from time to time request other than Personal Data mentioned in the Categories of Personal Data from you and subject to any notice to you, you are deemed to have consented to supply the said Personal Data to us. SOURCE OF PERSONAL DATA Your Personal Data will be collected through various methods including but not limited to:- 1. when you register for the Programme through the registration form via QR Code/POS/browser (Samsung tablet) (hereinafter referred as the “Registration Form”) 2. when you conduct certain type of transactions such as redemption and refunds 3. when you participate in surveys and type of research by fill in the evaluation form with respect to the Programme 4. when you communicate with us through our customer service centre, our co-worker for the Programme 5. when we interact with the third party service providers 6. when we collect information from your business cards, social media platform such as Instagram, Facebook, roadshows, CCTV recording, telephone calls, email/website Consequences from failure to supply Personal Data In the event you failed and/or choose not to provide us the Personal Data marked with asterisk (*) in the Registration Form in which it is obligatory in nature, we shall not be held responsible to provide full range of services under the Programme to you including but not limited to the Members registration and/or to update you with any information relating to the Programme. DISCLOSURE AND SAFEGUARDS OF PERSONAL DATA We undertake to keep your Personal Data confidential and will not sell, transfer, or disclose your Personal Data to any third party. However, your Personal Data may be provided to the following third parties for the Purposes hereinabove mentioned including but not limited to: 1. ours’ representative, third parties service providers and/or subcontractors and our associates 2. to our joint venture/business partners that is allowed to provide services to Members as may be necessary or appropriate 3. any person that in our’s opinion deemed proper to transfer any of its rights and/or duties relating to the Programme 4. or else allowed under Malaysian law or any regulatory authority, including without limitation, the Personal Data Protection Act 2010. In this respect we undertake to only disclose your Personal Data to third parties hereinabove mentioned and the said third parties will only use your Personal Data in accordance with the terms and condition stipulated herein, kindly note that if you wish to limit with whom your Personal Data is being used and/or disclosed, you may at any time write to us for us to take any necessary action. We further undertake to take a proper measure by implement the security safeguards and follow the standard of procedures in other to keep your Personal Data in a secure manner in accordance with the applicable laws to avoid any unauthorized processing of your Personal Data that may cause accidental loss or destruction to your Personal Data. ACCESS AND CORRECTION OF PERSONAL DATA We shall keep your Personal Data within the reasonable period to fulfill the Purposes of the Notice unless a longer retention period is permitted or required by law. In compliance with the Act, you may at any time request right to access and to amend, update and/or correct your Personal Data which you have previously submitted to us by contacting our Customer Service Centre at and we shall within a reasonable time, respond to such request. In the event we decide to refuse such request, we shall by way of notice in writing inform you the reasons of such refusal. THIRD PARTIES PERSONAL DATA Pursuant to the Personal Data of third parties supplied by you to us, you shall ensure such third parties have read the Notice and willingly to give their consent for us to collect their Personal Data in the manner prescribed in the Notice. We reserve the right to amend this Notice from time to time. Any material changes will be posted on our website with the updated Notice.
